Terms of Service

These Terms of Service ("Terms") govern your access to and use of Drift Fund (the "Service"), including our website, trader portal, and trading terminal. By creating an account, purchasing a challenge, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What Drift Fund is
Drift Fund is a proprietary trading firm that evaluates trading skill. You demonstrate your ability in a simulated trading challenge; traders who pass receive a funded account and may earn a performance-based profit share.
The Service operates in a simulated environment using virtual funds and demo balances. No orders are placed on live external markets, and no money is invested or deposited on your behalf. Any profit split paid to a funded trader is a performance-based reward funded by us — it is not a return on an investment, a deposit, or a financial instrument.
2. Eligibility
You must be at least 18 years old and legally permitted to use the Service in your jurisdiction. The Service is not available to persons located in countries subject to international sanctions or listed as high-risk by the FATF. By using the Service you confirm you meet these requirements and are using it in compliance with the laws that apply to you.
3. Accounts and registration
You must provide accurate, current information when registering and keep it up to date. You are responsible for safeguarding your login credentials and for all activity under your account. You may correct your display name and country from your dashboard at any time.
One person may operate their own account(s) subject to our funded-capital limits. Sharing, selling, or transferring accounts is not permitted.
4. Challenge fees
Access to a challenge requires a one-time fee, which is your only cost — there are no subscriptions or recurring charges. Fees are stated at checkout and are paid in cryptocurrency. Except where required by law or expressly offered by us, challenge fees are non-refundable once the challenge has started.
5. Trading rules and the risk engine
An automated risk engine enforces the same rules for every trader, including a profit target, daily and maximum drawdown limits, a minimum number of trading days, a mandatory stop-loss on each position, consistency requirements, and timing limits around high-impact news. The full, current rules are published in your portal and on our rules page and form part of these Terms.
Breaching a hard rule ends the account. We may adjust rules and risk parameters to protect the integrity of the evaluation; material changes are reflected on the rules page.
6. Funded accounts, profit split and payouts
Funded accounts remain simulated. Funded traders may keep up to 90% of the profits they generate. Withdrawals can be requested after meeting the published thresholds (including a minimum profit percentage, minimum account age, and minimum trading days) and are subject to the consistency rule.
Identity verification (KYC) is required before any payout. Payouts are made in cryptocurrency to a wallet you control. We may withhold or reverse payouts connected to rule breaches, prohibited conduct, fraud, or failed verification.
7. Prohibited conduct
You agree not to: exploit pricing, latency, or platform errors; use prohibited automated tools, bots, copy-trading or account-sharing where disallowed by the rules; coordinate trading across accounts to game the evaluation; engage in market abuse; or attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service. We may freeze, breach, or close accounts engaged in such conduct.
8. Intellectual property
The Service, including the trading terminal, branding, content, and software, is owned by us or our licensors and is protected by law. You receive a limited, non-transferable right to use the Service for its intended purpose. You may not copy, resell, or create derivative works without our permission.
9. Disclaimers
We are not a broker, bank, exchange, or financial institution, and we do not provide investment, financial, legal, or tax advice. Nothing in the Service is an offer or solicitation to buy or sell any financial instrument. Trading — including in a simulated environment — involves risk, and past performance does not indicate future results. The Service is provided "as is" and "as available" without warranties of any kind to the fullest extent permitted by law.
10. Limitation of liability
To the maximum extent permitted by law, Drift Fund and its operator will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, arising from your use of the Service. Our total liability for any claim is limited to the amount of the challenge fee you paid for the account giving rise to the claim.
11. Suspension and termination
We may suspend or terminate your access at any time for breach of these Terms, the trading rules, or applicable law, or to protect the Service and other users. You may stop using the Service at any time.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with a new "last updated" date. Continued use of the Service after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of Saint Lucia, without regard to conflict-of-law rules. Disputes are subject to the courts of that jurisdiction, except where mandatory consumer-protection law provides otherwise.
